These Terms of Service ("Terms") constitute a legally binding agreement between you and EduStreamr ("we," "us," or "our") governing your access to and use of the EduStreamr platform, website, and services. By accessing or using EduStreamr, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our platform.

EduStreamr is a platform designed for educational content creators to receive cryptocurrency tips during live streams. Throughout these Terms, "User," "you," and "your" refer to any individual or entity using our platform. Please read these Terms carefully as they contain important information regarding your legal rights, remedies, and obligations.

1. Eligibility​

  • You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to use EduStreamr.
  • You must have the legal capacity to enter into these Terms of Service.
  • Users from countries subject to economic sanctions (as defined by the United Nations, United States, European Union, or other relevant governing bodies) are prohibited from using the platform.
  • Users from countries or regions where cryptocurrency transactions are prohibited by law are not permitted to use EduStreamr.
  • It is your responsibility to ensure your use of EduStreamr complies with all applicable laws and regulations in your jurisdiction.

2. Platform Usage​

  • EduStreamr provides a platform for educational content creators to receive cryptocurrency tips during live streams.
  • You agree to use the platform only for its intended purposes and in compliance with these Terms of Service.
  • You are responsible for maintaining the security of your account credentials.
  • You acknowledge that your use of the platform is at your own risk and discretion.

3. Prohibited Activities​

The following activities are strictly prohibited on EduStreamr:

  • Any illegal activities
  • Money laundering or terrorist financing
  • Fraudulent transactions
  • Circumventing geographic restrictions
  • Harassment or bullying of other users
  • Distribution of malware or harmful code
  • Unauthorized access to other users' accounts
  • Spamming or excessive automated use of the platform
  • Impersonating another person or entity
  • Posting or transmitting content that infringes intellectual property rights
  • Using the platform to promote hate speech, violence, or discrimination
  • Any activity that could damage, disable, or impair the functioning of the platform

Violation of these prohibitions may result in potential legal action.

4. Payments and Transactions​

1. Cryptocurrency Transactions​

  • All payments and tips on EduStreamr are processed using cryptocurrency.
  • You acknowledge that cryptocurrency transactions are irreversible once confirmed on the blockchain.
  • We are not responsible for any losses due to user error, such as sending to incorrect addresses.
  • Transaction times depend on blockchain network conditions and may vary.
  • You are responsible for ensuring you have sufficient funds to cover transaction fees.

2. Platform Fees​

  • EduStreamr charges a platform fee of 2-5% on tips received through the platform.
  • We reserve the right to modify our fee structure with appropriate notice to users.
  • All fees are automatically deducted from transactions at the time they occur.

3. Tax Obligations​

  • You are solely responsible for determining what, if any, taxes apply to your transactions on EduStreamr.
  • We do not provide tax advice or calculate tax liabilities for users.
  • We may be required to report certain transaction information to tax authorities.
  • You agree to comply with all applicable tax laws and regulations in your jurisdiction.

5. Disclaimer​

  • THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
  • WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  • WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE PLATFORM.
  • WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY CONTENT POSTED BY USERS.
  • CRYPTOCURRENCY TRANSACTIONS INVOLVE RISK, AND YOU ACKNOWLEDGE THAT YOU ARE USING THE PLATFORM AT YOUR OWN RISK.
  • WE DO NOT GUARANTEE THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

6. Limitation of Liability​

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUSTREAMR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • OUR LIABILITY IS LIMITED TO THE PLATFORM FEE YOU HAVE PAID TO US IN THE PAST SIX MONTHS, OR $100, WHICHEVER IS LOWER.
  • WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
  • WE ARE NOT LIABLE FOR ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN.
  • WE ARE NOT LIABLE FOR ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH THE PLATFORM.
  • THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Modifications​

1. Modification of Terms​

  • We reserve the right to modify these Terms of Service at any time at our sole discretion.
  • Your continued use of the platform after such modifications constitutes your acceptance of the updated Terms of Service.
  • If you do not agree with the modified terms, you must stop using the platform.
  • It is your responsibility to review these Terms of Service periodically for changes.
  • The most current version will always be available on the EduStreamr website.

2. Modification of Platform​

  • We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time without prior notice.
  • We may make changes to the platform for various reasons, including but not limited to technical adjustments, security updates, compliance with legal requirements, or improvements to user experience.
  • While we strive to provide advance notice of significant changes, we are not obligated to do so, and some changes may be implemented immediately without prior notification.
  • In case of planned maintenance or significant updates that may affect platform availability, we will attempt to provide reasonable notice through our official communication channels.
  • You acknowledge that temporary interruptions of the service may occur during updates or maintenance periods.
  • We are not liable for any loss, damage, or inconvenience caused by platform modifications or temporary unavailability.
  • If a platform modification materially affects your ability to access or use the service, your sole remedy is to discontinue using the platform.
  • Any data or content you have submitted to the platform may not be recoverable after a modification or termination of the service.
  • Upon termination of the platform, we will make reasonable efforts to allow users to withdraw their funds within a specified timeframe, but we cannot guarantee that this will always be possible due to technical or regulatory constraints.
